Sales Terms & Conditions
Premise
These conditions of sale (hereinafter only "Terms") apply to shopping from Terranova srl (Terranova below), owner of the web shop "Mareshop" and "Umberto Pelizzari". All contracts for purchase of products through the site shop.umbertopelizzari.com are in accordance with the following terms and conditions.
All published prices include VAT for European Union deliveries.
For deliveries outside the European Union, VAT is not applicable. Local customs duties and taxes may be applied by destination country. We invite customers to verify with local authorities.
Acceptance of terms of sale
1. The contract between Terranova and the Customer is effective with the acceptance, even partial, by Terranova, who reserves the right to refuse the order at its own discretion. Acceptance is deemed confirmed when Terranova sends the purchase receipt or invoice to the Customer. By placing an order, the Customer declares to have read all the information provided during the purchase procedure and accept the general conditions written here below.
2. If the customer is a consumer (ie a person who buys goods for purposes not related to his profession), it i intended that he will will print or save an electronic copy to keep the present general conditions of sale, as per requirements of Art. 3 and 4 of Italian Dlgs No 185/1999 on distance sale.
3. Any opposition of the Customer in case of damages or compensation, for direct or indirect damages to persons or property, caused by lack of acceptance, even partial, of an order is explicitly excluded.
How to Buy
1. The customer may purchase only products available in the electronic catalog at the time of placing the order and viewable at shop.umbertopelizzari.com, as described in the relevant information sheets. Product descriptions on the site shop.umbertopelizzari.com faithfully reproduce those of the manufacturers. Terranova, therefore, reserves the right to change the technical description of products to match those provided by the manufacturer, without any notice. Product pictures are not fully representative of its characteristics, and may differ in color, size, and accessories. All support information for sale, are intended as generic information, not connected to real features of each product. For detailed product feature, we invite the customer to visit the Manufacturer's web site.
2. Order confirmation by Terranova will be sent by e-mail, to customer's email address supplied. This confirmation message will contain date and time of order and a 'Customer Order Number', to be used in any further communication with Terranova. The message will include all data entered by the customer, who agrees to verify the correctness and communicate any corrections, as described in this document.
3. In the case of order non-acceptance, Terranova will give a prompt notice to the customer.
4. All prices on this site are final customer prices and, therefore, include VAT. Terranova reserves the right to change prices at any time without notice, keeping safe from price variations all orders already accepted and in progress at the moment when the variation occurred.
5. Product availability is viewable on the site shop.umbertopelizzari.com in real time. Since the simultaneous access of many users / customers and the simultaneous ability to order on-line may alter product availability, Terranova does not guarantee the certainty of merchandise allocation.
6. On products subject to price promotions, Terranova reserves the right to accept orders by reducing the amount, upon notice and acceptance by the Client, failing which the order will be canceled.
Payment Types
All payments are in Euro currency. The currency conversion rate is updated daily and based on public lists. The amount debited on your credit card or paypal account, in case of payment, is calculated always in Euros, so there could be discrepancies in final price, due to Paypal or your Credit Card company currency rates.
1. Advanced Bank Transfer
Payment by bank transfer is only accepted from banks within the Eurozone.
If paying by bank transfer in advance, the order will be processed and shipped after actual crediting of the entire order amount on Terranova current account. Credit must occur within 5 working day from the date of acceptance, after which the order is automatically canceled. To prevent order cancelation in case of banking system delays, we suggest to anticipate a copy of the bank transfer order to our Customer Service.
The subject of the bank transfer must include the identifier of the order (date and order number), which is released in the order confirmation email.

2. PayPal
In case of purchase through the PayPal payment method, at the end of the order the customer is directed to the PayPal login page.
The amount of the order is debited in your PayPal account at the time of order. In case the processing of PayPal payment is not completed, the order will remain pending for one hour, after that it will be deleted from the system and will be visible in registered customers' personal page. In this case, the customer will have to replace the order.
In case of cancellation by the Customer or non-acceptance by Terranova, the amount will be refunded to customer's PayPal account.
The cancellation is possible until order is not in stock preparation. The order status is clearly visible in the "Order Status" and is no longer voidable if the indication "order in process" is shown.
After deleting transaction, Terranova is not liable for any damages, direct or indirect, caused by delay in the refund of amount committed by PayPal. At no time during the purchase process Terranova is in a position to know the financial information of the customer. Since there is no data transmission, there is no possibility that this data are intercepted. No archive of Terranovacontains or maintain such data. For every transaction made through PayPal, the customer will receive a confirmation email from PayPal.
3. Credit Card
In case of purchase with Credit Card payment method, at the end of the order the customer is directed to the payment gateway page.
The amount of the order is debited on your Credit Card account at the time of order. In case the processing of Credit Card payment is not completed, the order will remain pending for one hour, after that it will be deleted from the system and will be visible in registered customers' personal page. In this case, the customer will have to replace the order.
In case of cancellation by the Customer or non-acceptance by Terranova, the amount will be refunded to customer's Credit Card account.
The cancellation is possible until order is not in stock preparation. The order status is clearly visible in the "Order Status" and is no longer voidable if the indication "order in process" is shown.

At no time during the purchase process Terranova is in a position to know the financial information of the customer. Transaction Security
The on-line transactions by credit card are held directly on the site of the Bank, through adopting the Secure Server protection system SSL (Secure Socket Layer).This protocol may communicate in a manner designed to prevent the interception, alteration or falsification of information. Terranova is not familiar with the data of credit cards used by its customers.
Delivery methods
Terranova can only accept orders for delivery in countries listed in checkout form. Any exception should be agreed in advance between Terranova and the Customer.
Terranova do not ship to P.O. Boxes or military bases.
Shipping charges are charged to the customer and are shown explicitly at the time of order placement. The payment will be done with the method chosen when ordering. No additional fees or commission are due to Terranova.
In case the shipment is returned to Terranova for non-receipt by the addressee within the time allowed, Terranova will refund the customer the amount paid net of all shipping costs.
Customers are responsible for any applicable customs duties or taxes that may be imposed on a delivery in the destination country outside the European Union. In case shipment is returned to Terranova due to unpaid duties and taxes at destination, Terranova will refund the customer the amount paid deducted by any shipping cost and all taxes and custom duties paid by Terranova.
The goods travel with packaging made from the factory or in cardboard boxes properly sealed with adhesive tape. In no case other sealing materials are used.
Delivery timing are for guidance only and may vary due to traffic conditions, external causes or in general or by act of the Authority. Standard delivery, unless otherwise agreed, will take place at the following times: from 9.00 to 13.00, from 14.00 to 18.00 daily, except holidays, from Monday to Friday.
No responsibility can be attributed to Terranova in case of delay in the order or delivery of goods ordered.
Upon delivery of the goods by the courier, the customer is required to check:
- The number of packages delivered corresponds to the order;
- The packaging is not damaged or wet or otherwise altered;
- No sealing materials other than tape were used.
Any external damage or the mismatch in the number of packages or particulars, must be immediately reported to the carrier making the delivery, adding the word "withdrawal conditional" on the appropriate document and confirming, within eight days by registered letter with acknowledgment of Return to the courier address on the accompanying document. In case of damaged package write "subject to removal because the package is damaged." It's also requested the opening of a ticket with Terranova by contacting Customer Service.
In case of delivery problems, the original packaging must always be saved.
Once signed the slip, the customer can not make any objection about external appearance of the goods.
Even with intact packaging, the goods must be verified within ten days after receiving. Any damages or hidden defects must be reported, within the above mentioned term of 10 days, by writing by registered mail with return receipt to the courier address on the accompanying document.
It's also requested the opening of a ticket with Terranova by contacting Customer Service.
Each alert over these terms will not be taken into account. For each statement, the customer assumes full responsibility for the statements.
Processing and delivery timing
1. Time order fulfillment
With "time of order fulfillment" we mean the amount of time that elapses from order entry to product delivery to the carrier.
All orders containing products in stock, with received confirmation of payment before 11.00 am on a business day, are delivered to the courier within the evening of that day.
2. Time of delivery courier
Delivery times vary depending on the service chosen and the destination and are displayed in the summary order. After the order was delivered to the carrier, Terranova can not be held liable for any delays in delivery.
Right of return
1. Under Article. 9 et following of Directive 2011/83/EU, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does the purchase by indicating in the order form to Terranova a reference to VAT), has the right to terminate the purchase contract for any reason without penalty and except as described in Section 3.
The Right of Withdrawal is governed by the Consumer Code and concerns only distance sales between the seller and private, non-professional consumers, so if the customer buys with a VAT number or as a company, he/she will not be allowed to the Right of Withdrawal.
2. To exercise this right, the customer must send to our Customer Service an explicit request in written form within 14 days fromafter the date of goods receiving (or pickup at pick point):

On receiving the above mentioned request, Terranova will send an e-mail to Customer confirming the reception of Customer's Withdrawal request and with instructions for returning the product to Terranova within 14 days after the date of Withdrawal request.
For custom made products, right of withdrawal is not permitted.
3. The right of withdrawal is subject to the following mandatory conditions:
- The law applies to product purchased in its entirety, it is not possible to exercise partial withdrawal of the product purchased;
- The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc. ...); to limit damage to the original package, we recommend, when possible, to put it in a second box. In any case, please do not apply labels or tape directly on the original packaging of the product;
- Goods subject to withdrawal should be returned as new, used or dirty products will not be accepted;
- Goods subject to withdrawal should have the same serial number as on bill of sale by Terranova, if the goods have a different serial number, the return will not be accepted and the product will be sent back to the Customer canceling the request for withdrawal;
- The cost of shipment for the return of the asset are charged to the customer;
- The shipment, until certificated receiving in our warehouse, is under the responsibility of the customer;
- If the goods are damaged during transport, Terranova will inform the client (within 5 working days after receiving the goods in their stores), to enable him to file a timely complaint against his choice carrier and to obtain refund for the value of the asset (if insured), in this case the product will be made available to the Customer for the return and the request for withdrawal cancelled;
- Terranova will not respond in any way for damage or theft / loss of goods returned by not insured shipments;
- in case of extra-EU sales, any eventual duty fee applicable to Terranova to receive the products will be in deducted from refundable amount.
4. Terranova will refund the customer the full amount paid for the returned products, as quickly as possible and within 14 days after receiving request of withdrawal, subject to receiving and verifying integrity of the goods. Terranova shall carry out the reimbursement using the same means of payment as the consumer used for the initial transaction.
Where this is not possible, the reimbursement will be with Bank Transfer, the client will promptly provide the bank data for the reimbursement (IBAN and current account owner).
In case of sales within EU and for products with value above 50€, Terranova will reimburse also competence shipping costs.
If the consumer has expressly opted for a type of delivery other than the least expensive type offered, Terranova shall not be required to reimburse the supplementary costs.
Duty fees for extra EU withdrawals, if applied to Terranova upon items receipt, will be deducted from refundable amount. Original shipment costs for non EU orders are not refundable.
5. The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or content), where Terranova finds:
- The absence of the outer packaging and / or internal packaging;
- The lack of integral elements of the product (accessories, cables, manuals, parts, ...) or defect to the product itself;
- Damage to the product for reasons other than transportation;
- A bad condition of the product due to its use.
The right of withdrawal is excluded in the cases listed in art. 59 of Italian Legislative Decree n. 205/2006.
The costs and risks of transport for the return are fully in charge of the customer. The return of products that are damaged, deteriorated or lacking in accessories and original equipment will not be accepted by Terranova and will be returned to the sender, charging him the shipping costs.
In the case of falling of the right of withdrawal, Terranova will return to sender the item purchased, charging him the shipping costs.
Warranties
1. All products sold by Terranova are covered under the manufacturer's standard warranty and 24-month warranty for defects, according to Legislative Decree No24/02. To use the warranty, the customer will keep the non-tax receipt received by mail.
2. Warranty service can be supported by Terranova, if customers ships the product back to Terranova's headquarter. Please note that any shipping cost to return the product to Terranova and/or to ship it back to customer, are on customer's charge.
3. The manufacturer's standard warranty is provided as explained in the documentation included in the packaging of the product. If, following inspection by an authorized service center, the defect is not covered by the manufacturer's standard warranty, the customer will be charged for any costs of verification and repair required by the Service Authorized, and the costs of transport if payed by Terranova.
4. The guarantee of 24 months under the Legislative Decree No 24/02 applies to products that present a lack of conformity, provided it is used correctly, respecting its intended use and as provided in the attached technical documentation. That guarantee, in accordance with the Decree. N. 24/92, is reserved only to the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase order form without indicating a reference to VAT). In case of lack of conformity, Terranova shall, at no cost to the customer, restore the product in case of repair by Authorized Technical Dealer or replacement or reduction in price, until the termination of the contract. If, following inspection by an authorized service center, should not be a lack of conformity in accordance with Legislative Decree No 24/02, the Customer will be charged for any costs of verification and restoration required by the Service Authorized, and transportation costs if payed by Terranova .
5. If, for any reason Terranova was not able to replace a warranted product (repaired or replaced), may proceed in agreement with the Customer, to replacement of the product itself or to the issue of a voucher for the same amount spent with validity of 6 months from the date of issue.
6. Terranova is not responsible for any delays in repairing or replacing products under warranty.
7. In cases where application of warranty is subject to return of the product, the product must be returned by Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc. ... ). To limit damage to the original package, it is recommended, when possible, to put in a second box. Please do not attach labels or tape directly on the original product packaging.
Jurisdiction and Applicable Law
The sales contract between the customer and Terranova is concluded in Italy and governed by Italian law. For the solution of civil litigation arising from the conclusion of this contract of sale at distance, if the customer is an italian consumer the jurisdiction is that of his town of residence, in all other cases the jurisdiction is Rimini.
Terms
